These Terms of Service govern your use of the Open Air Furniture LLC website and your purchase of products from us. By using this site or placing an order, you agree to these terms. Please read them carefully.

Who we are

Open Air Furniture LLC is a North Carolina limited liability company operating the online store at openairfurniture.com. We are an online retailer of outdoor patio furniture serving customers in the contiguous United States. We are a retailer: we source our products from established suppliers and manufacturers, and we do not manufacture products ourselves. References to we, us, and our in these Terms mean Open Air Furniture LLC.

Eligibility

You must be at least 18 years old and able to form a binding contract to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method supplied.

Products, descriptions, and images

We work to describe our products accurately, including dimensions, materials, and specifications. Product images are provided by our suppliers and are intended to represent the item faithfully, but colours may appear differently depending on your screen. Minor variation in wood grain, weave, and fabric colour is normal in outdoor furniture and is not a defect.

We reserve the right to correct errors in product descriptions, specifications, and pricing, and to update product information at any time without notice.

Pricing and availability

All prices are shown in US dollars and are subject to change without notice. Availability is not guaranteed until an order is accepted and confirmed. If a product is listed at an incorrect price due to an error, we reserve the right to cancel the order and issue a full refund, whether or not the order has been confirmed.

Orders and payment

Your order is an offer to purchase. We may accept or decline any order at our discretion, including where a product is unavailable, where we suspect fraud, or where a pricing or description error has occurred. If we decline an order after payment has been taken, we will issue a full refund.

Payment is taken at the time of order through our payment processor. We do not store full payment card details on our systems.

Shipping, returns, and warranty

Delivery terms are set out in our Shipping Policy. Returns and refunds are governed by our Refund and Return Policy, which includes the important detail that return shipping is the customer's responsibility except where an item arrives damaged, defective, or incorrect. Product defect coverage is set out in our Warranty. Each of those policies forms part of these Terms.

Intellectual property and acceptable use

The content of this site, including text, layout, graphics, and original photography, belongs to Open Air Furniture LLC or is used with permission. You may not copy, reproduce, or republish it for commercial purposes without written consent.

You agree not to use this site to transmit malicious code, attempt to gain unauthorized access to our systems, scrape content for commercial purposes, harass our staff or other customers, or place fraudulent orders.

Disclaimers and limitation of liability

This site and its content are provided on an as-is basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose beyond the coverage expressly provided in our Warranty.

Outdoor furniture is intended for residential outdoor use. It is your responsibility to follow assembly instructions, observe stated weight capacities, and secure or store furniture appropriately in high winds and severe weather.

To the fullest extent permitted by law, the total liability of Open Air Furniture LLC arising from any order is limited to the amount you paid for the product concerned. We are not liable for indirect, incidental, or consequential damages, including property damage or loss of use, arising from the use or misuse of a product. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence.

Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising from these Terms or from a purchase will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

You agree to indemnify Open Air Furniture LLC against claims arising from your breach of these Terms or your misuse of a product.

We may update these Terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.
